1. Acceptance of Terms

By using Chomky ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service. The Service is provided via WhatsApp and is subject to both these terms and WhatsApp's own terms of service.

2. Description of Service

Chomky is a WhatsApp-based spaced repetition learning assistant. You can send text, voice messages, and images to create flashcards. Chomky uses AI to generate flashcards, evaluate your answers, and schedule reviews using a spaced repetition algorithm to help you learn and remember information effectively.

3. User Responsibilities

• You must have a valid WhatsApp account to use the Service.
• You are responsible for the content you send to Chomky. Do not send illegal, harmful, or offensive content.
• You must not attempt to abuse, overload, or interfere with the Service.
• You must not use the Service for any commercial purpose without prior consent.
• You are responsible for the accuracy of information you provide for flashcard creation.

4. AI-Generated Content

Chomky uses artificial intelligence (OpenAI) to generate flashcards, evaluate answers, analyze images, and transcribe voice messages. AI-generated content may not always be accurate, complete, or up-to-date. The Service is intended as a learning aid and should not be relied upon as a sole source of factual information. We are not responsible for any inaccuracies in AI-generated content.

5. Intellectual Property

You retain ownership of the content you send to Chomky. By using the Service, you grant us a limited license to process your content for the purpose of providing the Service (creating flashcards, evaluating answers, etc.). Flashcard content generated by AI based on your input is provided for your personal use.

6. Image Search

When Chomky searches for images to include in flashcards (e.g., when exploring a topic), images are sourced from publicly available web sources. We do not claim ownership of these images. If you believe an image infringes on your copyright, please contact us for removal.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

8. Account Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including violation of these terms. You may stop using the Service at any time by simply not messaging Chomky. You may request deletion of your data at any time.

9. Changes to Terms

We may modify these Terms & Conditions at any time. Changes will be reflected on this page. Continued use of the Service after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation first.
